Terms of Use

By accessing or using the RatesQ website, mobile application, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Use ("Terms"), our Privacy Policy, and all other policies incorporated by reference. If you do not agree, do not use the Platform.

These Terms constitute a legally binding agreement between you and RatesQ LLC ("RatesQ," "we," "us," or "our"). RatesQ may update these Terms at any time. Continued use of the Platform after notice of changes constitutes acceptance of the updated Terms.

RatesQ is an independent technology marketplace and communication platform. RatesQ allows consumers to describe their mortgage needs and receive informational quote responses from independent, licensed mortgage professionals who choose to participate on the platform.

RatesQ is a technology company. RatesQ earns revenue through subscriptions, advertising, sponsorships, promotional placements, and marketplace participation fees paid by mortgage professionals and advertising partners.

RatesQ does not act as a mortgage broker. RatesQ does not recommend, select, rank as best, steer, negotiate with, or arrange credit from any particular mortgage professional. Consumers independently choose whether to contact or engage any mortgage professional listed or responding through the platform.

RatesQ does not hold, and does not represent that it holds, any mortgage broker license, mortgage lender license, or NMLS identification number. Any NMLS references on the Platform relate solely to third-party mortgage professionals who are required to maintain their own licenses.

RatesQ's role is limited to providing a technology platform that enables consumers to submit informational mortgage requests and receive informational responses from independent licensed mortgage professionals. RatesQ does not participate in, review, approve, or influence any mortgage transaction, loan negotiation, pricing decision, or lending determination.

RatesQ does not originate mortgage loans, issue Loan Estimates, issue Closing Disclosures, make credit decisions, set interest rates, approve or deny loan applications, or make any determination regarding a consumer's creditworthiness or eligibility for any mortgage product. All such activities are performed solely by independent licensed mortgage professionals outside the RatesQ platform.

RatesQ is not a loan application portal. Submitting a quote request through RatesQ is not a mortgage application and does not constitute a formal application for credit under the Equal Credit Opportunity Act (ECOA), Truth in Lending Act (TILA), or any other applicable law.

Any formal mortgage application must be completed directly with a licensed lender, mortgage broker, or mortgage loan originator, outside of the RatesQ platform.

RatesQ is designed to allow consumers to explore mortgage options without exposing their identity or sensitive personal information to mortgage professionals until the consumer chooses to initiate direct contact. The Platform's anonymous quote request feature is a consumer protection feature, not a guarantee of privacy from all parties in all circumstances. Consumers are responsible for any personal information they voluntarily share.

• You must be at least 18 years of age to use the Platform.
• You must provide accurate, complete, and truthful information when using the Platform.
• You are responsible for maintaining the security of your account credentials.
• You must not use the Platform for any unlawful purpose or in violation of these Terms.
• You must not transmit viruses, malware, spam, or other harmful content.
• You must not attempt to circumvent the Platform's security or access controls.
• You are responsible for all activity that occurs under your account.

• Partners must maintain all required licenses, registrations, and authorizations for the states in which they operate.
• Partners must provide accurate, truthful, and non-misleading information on their profiles and in all quote responses.
• Partners must not engage in bait-and-switch pricing, guaranteed approval claims, or other deceptive practices.
• Partners must comply with all applicable federal and state mortgage lending laws, including RESPA, TILA, ECOA, and the Fair Housing Act.
• Partners must not share consumer information outside the Platform without proper consumer consent.
• Partners are solely responsible for their own conduct, quotes, representations, and compliance with applicable law.

RatesQ may designate certain partners as "Marketplace Verified." Marketplace Verification means RatesQ has performed a limited operational review of certain information submitted by a partner, which may include publicly available licensing information, business information, and platform eligibility requirements.

Marketplace Verification does not constitute an endorsement, recommendation, guarantee, certification, warranty, or representation regarding any partner's qualifications, services, rates, licensing status, financial condition, or compliance with applicable laws. Consumers must independently verify any mortgage professional before sharing sensitive information or entering into any transaction.

All mortgage professionals on the Platform are independent third parties. They are not employees, agents, representatives, or affiliates of RatesQ. RatesQ is not responsible for their conduct, representations, pricing, availability, licensing status, compliance, or the outcome of any mortgage transaction. RatesQ does not endorse, recommend, or guarantee the services of any mortgage professional on the Platform.

RatesQ's compensation model is designed to comply with Section 8 of the Real Estate Settlement Procedures Act (RESPA), 12 U.S.C. 2607, and its implementing regulation, Regulation X. RatesQ does not receive referral fees, kickbacks, or fee splits in connection with the referral of any real estate settlement service. RatesQ's fees are for platform access, subscription, advertising, and marketplace participation only, and are not conditioned on, or tied to, the origination, closing, or terms of any mortgage transaction.

RatesQ makes no guarantee, representation, or warranty that any consumer will receive a particular interest rate, APR, loan amount, loan term, or be approved for, or successfully close, any mortgage transaction. Mortgage availability and terms are determined solely by independent licensed mortgage professionals and are subject to each consumer's individual creditworthiness, income, assets, property eligibility, and applicable law.

The QTalk community forum contains user-generated content. RatesQ does not author, endorse, verify, or take responsibility for the accuracy, legality, or appropriateness of user posts. QTalk content does not constitute legal, financial, mortgage, tax, or real estate advice.

By posting on QTalk, you grant RatesQ a non-exclusive, royalty-free, worldwide license to display, distribute, and moderate your content. RatesQ reserves the right to remove any content that violates these Terms or our Community Guidelines without notice.

The QMarket section of the Platform contains paid advertising placements. Advertisements are clearly identified. RatesQ does not endorse any advertiser or its products. RatesQ is not responsible for the accuracy of advertiser claims. Consumers should exercise independent judgment when evaluating any advertisement.

• Using the Platform for any fraudulent, deceptive, or unlawful purpose.
• Impersonating any person or entity or misrepresenting your affiliation.
• Collecting personal information about other users without their consent.
• Transmitting spam, bulk communications, or unsolicited marketing messages.
• Reverse engineering, scraping, or attempting to extract Platform data at scale.
• Using automated bots, scripts, or crawlers without prior written permission.
• Interfering with the Platform's technical infrastructure or security systems.
• Uploading or transmitting malicious code, viruses, or harmful files.
• Violating any applicable federal, state, or local law or regulation.
• Engaging in discriminatory conduct based on any protected characteristic.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify RatesQ immediately at [email protected] if you suspect unauthorized access. RatesQ will not be liable for losses arising from unauthorized account access caused by your failure to maintain credential security.

All content on the Platform, including but not limited to text, graphics, logos, trademarks, software, and data, is the property of RatesQ or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without prior written permission from RatesQ. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for its intended purpose.

If you submit suggestions, ideas, feedback, or other materials to RatesQ, you grant RatesQ a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate such feedback into the Platform or other products without any obligation or compensation to you.

The Platform may contain links to third-party websites. These links are provided for convenience only. RatesQ does not endorse, control, or take responsibility for the content, accuracy, or practices of any third-party website. Accessing third-party websites is at your own risk and subject to their own terms and privacy policies.

If you believe a partner or user is engaging in fraudulent, misleading, or unlawful conduct, please report it immediately through the Report Abuse page or by contacting [email protected]. RatesQ takes reports seriously and will investigate in accordance with our policies, though we cannot guarantee a specific outcome.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. RATESQ DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RATESQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF RATESQ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. RATESQ'S TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID TO RATESQ IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless RatesQ and its officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, your violation of any third-party rights, or any content you submit to the Platform.

Except for disputes eligible for small claims court, any dispute, claim, or controversy arising from or relating to these Terms or your use of the Platform shall be resolved by binding individual arbitration administered by JAMS under its applicable rules. The arbitration shall be conducted in [insert state] unless otherwise agreed. The arbitrator's decision shall be final and binding.

TO THE EXTENT PERMITTED BY LAW, YOU AND RATESQ EACH WAIVE YOUR RESPECTIVE RIGHTS TO A JURY TRIAL IN ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM.

Notwithstanding the arbitration agreement, either party may bring an individual action in small claims court for disputes that qualify under that court's jurisdictional limits, provided the action remains in small claims court and is not removed or appealed to a court of general jurisdiction.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Subject to the arbitration agreement, you and RatesQ consent to the exclusive jurisdiction of the courts located in Delaware for any dispute not subject to arbitration.

RatesQ may update these Terms at any time by posting the revised version on the Platform with an updated effective date. For material changes, RatesQ will provide notice through the Platform or by email. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms.
